The Certificate of Title under the Land Transfer Act (hereinafter referred to as the State Certificate of Title) is the main land title document.

Our company provides the service “Obtaining (transferring) of the State Certificate of Title” for legal entities. We provide consultation with experts, as well as apply for and receive the State Certificate of Title in Kyiv or Kyiv region.

Documents Required for Legal Entities to Obtain a State Certificate of Title

The procedure for obtaining a new State Certificate of Title requires  the following documents:

  • a notarized copy of the document on alienation of the land plot, certified by the village council (purchase and sale agreement, deed of gift, agreement of exchange, certificate of inheritance, court decision);

  • a notarized copy of the State Certificate of Title;

  • an act of installation and coordination of land plot’s borders on the ground;

  • a copy of the certificate of restrictions and encumbrances on the land plot;

  • a copy of the certificate of valuation (expert and/or normative);

  • notarized copies of all constituent documents of the legal entity.

The procedure  for transferring the State Certificate of Title requires the following documents:

  • The original purchase and sale agreement, deed of gift, agreement of exchange, certificate of inheritance, court decision, etc;

  • The original of the old State Certificate of Title;

  • notarized copies of all constituent documents of the legal entity.

Registration of a new land certificate with our lawyers

The registration (re-registration) of the State Act to land is necessary in the following cases:

  • according to the contract of sale and donation of the land plot;
  • if you have purchased a part of the land plot (according to the cadastral plan);
  • if you have purchased one of the land plots specified in the seller's state certificate;
  • if you have changed the legal form of the legal entity, name, etc;if you have lost the state certificate;
  • if you have inherited;
  • if you have become the owner of the land plot by the court decision to establish the ownership right;
  • in other cases, which are provided by the legislation of Ukraine.

There are two ways to re-register a state act for land:

  • Production of a new state certificate for the new owner of land;
  • Mark the old state certificate on the land on the transfer of the owner's right to land.

What you need to know about the procedure of obtaining a State Certificate of Title

Obtaining (transferring) of the State Certificate of Title is not required in the following cases:

  • According to the agreement of sale and purchase and gift of a land plot;

  • If you acquired a part of the land plot (according to the cadastral plan);

  • If you purchased one of the land plots specified in the seller’s State Certificate of Title;

  • If you have changed the type of the legal entity, name, etc;

  • If you lose your State Certificate of Title;

  • If you have become the owner of the land plot pursuant to a court decision on establishment of the right of ownership;

  • In other cases stipulated by the law of Ukraine.

You can change the old State Certificate of Title to a new one in two ways:

  • by issuing a new State Certificate of Title to the new owner of the land;

  • by making a mark on the old State Certificate of Title on transferring the owner’s right to land.
