Obtaining a temporary residence permit on the basis of marriage

To begin working with a foreigner, at first the consulting is needed for defining a strategy of actions. For that, it is necessary to specify the following information from the client:

  • Is the marriage registered?

  • What is the country of the foreigner’s citizenship?(a visa/visa-free country)

  • What is the period of stay of the foreigner in Ukraine? (Critically it shall not exceed 20 business days in the last 180 calendar days!)

  • Has a foreigner been banned from entering Ukraine?

  • What is the validity of the foreigner’s passport and does a foreigner have blank pages in the passport? (Validity period must be at least 1.5 years, blank pages are necessary for entry/exit stamps and visa)

  • What is the place of registration of the receiving party (spouse) in Ukraine?

It is also necessary to request from the Client a scanned copy of the following documents, and/or having those documents with him at consulting:

  • Original copy of foreigner’s passport;
  • Original copy of recipient’s passport (husband’/wife’s);
  • Original copy of Marriage certificate;
  • Foreigner’s 4 matte photos 3.5x4.5
  • Original copy of foreigner’s TIN (if any).

After becoming familiar with the documents and getting all reliable information, one can get down to the following stages:

  • getting a type C visa;
  • entering the territory of Ukraine on the short-term type C visa;
  • registration of marriage with citizen of Ukraine;
  • leaving Ukraine:
  • getting a type D visa;
  • entering the territory of Ukraine;
  • personal submission of documents and getting a Residence permit;
  • registration of place of residence and getting a document of residence place registration.

STAGE 1. GETTING A TYPE C VISA AND REGISTRATION OF MARRIAGE

Marriage is a reason for getting a residence permit. That may be the marriage registered both in Ukraine and abroad.

At this stage we can support the client at getting a short-term type C visa, submission of marriage application to the Registry Office, and getting a Certificate of marriage registration.

There is no need in getting a type C visa for foreigners in whose countries an agreement of visa-free travel was signed. In that case, a foreigner may enter Ukraine, with the purpose of contracting a marriage, without a type C visa.

For getting a type C visa, the following documents should be submitted to the consular office:

  1. Foreigner’s passport;
  2. Notarized translation of passport;
  3. Insurance for the sum of 30 000 Euros;
  4. Visa application form;
  5. Instruction (necessary for the client to get prepared for an interview);
  6. 1 matte photo 3.5 x 4.5;
  7. Notarized invitation from the foreigner’s bridegroom/bride for entering Ukraine;
  8. Bank reference with an ink stamp and information about the balance of foreigner’s personal account.

Separately, on site, the client shall pay the consular fee – 2250 Hrn.

After getting a type C visa, a foreigner may enter Ukraine with the purpose of “Registration of marriage” and submit documents to the Registry Office for getting a Certificate of marriage registration. For that procedure, the client will need the notarized translation of the passport.

After 30 days, the client can take the Certificate of marriage registration.

The period of performance of the stage: 10 work days – type C visa; 30 calendar days – Certificate of marriage registration.

STAGE 2. GETTING A TYPE D VISA

After getting a Certificate of marriage registration, a foreigner should leave the country for getting a type D visa at consular offices.

To get a type D visa, the following documents are to be submitted to a consular office abroad:

  1. Foreigner’s passport;
  2. Notarized translation of passport;
  3. Copy of husband’s/wife’s passport;
  4. Notarized copy of the Certificate of marriage registration;
  5. Insurance for the sum of 30 000 Euros;
  6. Visa application form;
  7. Instruction (necessary for the client to get prepared for an interview);
  8. Invitation (the first invitation can be used);
  9. 1 matte photo 3.5 x 4.5;
  10. Bank reference with an ink stamp and information about the balance of foreigner’s personal account.

Separately, on site, the client shall pay the consular fee – 2250 Hrn.

The period of performance of the stage: 10 working days – type D visa;

STAGE 3. SUBMISSION OF DOCUMENTS TO THE STATE MIGRATION SERVICE FOR RESIDENCE PERMIT

After getting a type D visa, the client should come to Ukraine and submit documents for getting a residence permit at the place of husband’s/wife’s registration.

The documents to the Migration Service should be submitted at least 15 calendar days before expiration of foreigner’s legal stay in Ukraine!

To get a residence permit for the reason of marriage, a foreigner in husband’s/wife’s presence should provide the following documents:

  • Foreigner’s passport;
  • Notarized translation of foreigner’s passport;
  • A copy and an original copy of husband’s/wife’s passport;
  • A copy and an original copy of the Certificate of marriage registration;
  • Insurance for one year;
  • Recipient’s petition;
  • TIN (if any);
  • Receipt for payment of administrative fee.

It takes up to 3 hours for submission of documents to the Migration Service through the DP “Document”. Also, when submitting the documents, a foreigner is photographed and his/her fingerprints are taken for the Demographic register.

After 15 working days (in practice – after 1 month), an SMS about residence permit being ready comes for the phone number that was specified in the database. After getting an SMS, a foreigner can get a ready residence permit.

STAGE 4. FOREIGNER’S REGISTRATION

After getting a residence permit, a foreigner has 30 days for registration of his/her place of residence at husband’s/wife’s address. The period of registration is up to two days.

Validity period of residence permit is 1 year.

Is there a difference with whom you get married in Ukraine?

Let’s look at several options, depending on who your future spouse is.

Option 1: Residence Permit by marriage, if you are married to a citizen of Ukraine.

This option fits the procedure described above. Marriage to a citizen of Ukraine allows the foreigner to get a Residence Permit in Ukraine on the basis of marriage for 1 year, with the possibility of extension.

If the foreigner has been married to a citizen of Ukraine for more than 2 years, a foreigner gets the right to apply for a permanent residence permit in Ukraine.

Please note! If the marriage of a foreigner with a citizen of Ukraine was concluded in another country, the documents confirming the marriage will need to be legalized. Our lawyers will tell you how to do it or we can take care of the documents on our own.

Option 2. Residence permit by marriage, if the marriage is concluded with a foreigner who has a residence permit in Ukraine.

If your spouse already has a residence permit in Ukraine, for example, on the basis of a work permit, you have the right to obtain a residence permit for the pur[ose of the family reunification.

In this case you also need to legalize the marriage documents, provide a document about the availability of sufficient financial support, and to provide a copy of the residence permit of your spouse, on the basis of which they have the right to stay and reside in Ukraine.

Can I get not a residence permit but a permanent residence permit in Ukraine on the basis of marriage?

 

A Permanent Residence Permit is also issued on the basis of marriage, but an important detail is that you are entitled to apply for a Permanent Residence Permit only after two years from the date of the marriage registration.
