How is the inclusion in the register of operators and providers in Ukraine?

We were contacted by a Client who had previously operated as a telecommunications service provider, but over time, for objective reasons, stopped its activities. Now he decided to return to his past activities, so he needed help with the re-incorporation into the register of operators and providers of Ukraine.

During the time when our Client was not engaged in the abovementioned activity the legislation has changed a little, so he wanted to get up-to-date information about the following aspects of starting the activity:

• How to quickly join the registry of telecommunications operators and providers?
• What is needed for re3gistration?
• How to conduct business activity so that the National Commission for State Energy and Public Utilities Regulation (NEURC) does not take you off the register?

Today, we will elaborate on the procedure of incorporation in the registry on the example of our Client, talk about how to fill out the necessary documents, and where they must be submitted.

What documents are needed for incorporation in the register of operators and providers of Ukraine and how to prepare them?

In order to be incorporated in the register of operators and providers, it is necessary to submit a notice of the beginning of these activities to the National Commission for the State Regulation of Communications and Informatization. The notification must contain a rather long list of data, in particular: the service type code, the name of the telecommunications service type, the territory in which the activity will be carried out, the description of the telecommunications activity type, all these data must be specified.

Please note! There is administrative liability for failure to notify of the economic activity in the field of telecommunications from UAH 17,000 to UAH 34,000. (Article 164 of the COA).

In 2020 the procedure, form of notification, approximate list of types of telecommunication services and forms of their description, as well as the term of registration or introduction of changes to the NCCRI register were determined - it will take only 5 business days, without bringing such kinds of questions to the meeting. This procedure is fast enough, provided that all documents are properly executed.

Another innovation is that if an operator or provider discovers an error in the data indicated in a message, it takes 10 business days to correct it. Information is not considered unreliable or submitted incompletely if correct data were submitted to the relevant authority within the specified period.
