In December of 2016 our law firm was contacted by one of loyal Clients who wanted to close a drugstore of his. But while wishing to close the main drugstore he decided to keep one of its units. To perform such a task he requested our legal services.

The Client was worried about the need to re-pass the inspection of the State Service of Ukraine on Medicines And Drugs Control, which, in his/her opinion, was inevitable. He/she also did not fully understand the statutory procedure for placing placing a pharmacy unit under control of another pharmacy, so he/she did not know where to start: from closing down a pharmacy or placing a pharmacy unit under control of another pharmacy.

Having delved into the law and studied the practice of the State Service of Ukraine on Medicines And Drugs Control on the issue of placing pharmacies under control of another ones, we informed the Client that he/she would not have to close down and reopen their pharmacy. You can also avoid re-licensing. However, the legislation does not clearly regulate this procedure.

At the end of December 2016, new licensing conditions for carrying out economic activities for the production of medicines, wholesale and retail pharmaceutical trading came into force. According to the old rules, any changes concerning the pharmacy institution had to be notified to the licensing authority in any written form. Since December 20, 2016, the forms of many forms have been approved, which were not there before, but the form for subordinating the pharmacy unit to another pharmacy was not provided for. In this case, in the absence of legislative regulation and the practice of the licensing authority, the experience gained by our lawyers in dealing with the State Service of Ukraine on Medicines And Drugs Control was useful to the Client. That’s what allowed us to successfully complete our task from the first submission of documents, avoiding further work and loss of time.

Within a week from the moment the Client signed the package of documents, information on the subordination of the pharmacy institution was updated in the license register. Our Client was pleased that everything happened much easier and faster than they had expected.
