Dental license for an individual entrepreneur and his employees
In March 2014, we were contacted by an individual entrepreneur wishing to obtain a Medical License. After many years of work for healthcare facilities, our Client decided to open his own dental office.
He planned to carry out activities in the specialties “Therapeutic dentistry” and “Orthodontics”.
At the time of contacting our company, the Client has already obtained the conclusion of the Sanitary and Epidemiological Service of Ukraine confirming the compliance of its premises with the requirements of the medical law.
In addition to doctors, the conclusion of the Sanitary and Epidemiological Service also comprised the specialties of junior specialists with medical education, namely “Nursing” and “Dentistry”.
The work on obtaining the license was carried out in two directions: advising the Client on compliance with the licensing regulations in the field of medical practice and preparing a package of documents to be submitted to the Ministry of Health of Ukraine on the basis of information provided by the Client.
Thus, our lawyers consulted the Client on the available equipment, which did not fully meet the requirements for equipping the dental office. Some equipment was outdated and the Client was recommended to buy new equipment, which would not raise any questions from the Ministry of Health. Other equipment, i.e. measuring equipment subject to metrological verification, did not have the appropriate verification documents.
We also advised the Client on the extension of the lease agreement, which served as a proof of the right to use the premises.
Our lawyers also clarified the requirements for the signage on the facade of the dental office.
In terms of filling in the statements of the company, we have developed the entire package of documents in the shortest possible time, paying special attention to the methods used in medical practice according to the declared specialties, properly planned the doctor’s schedule taking into account the requirements of labor legislation.
Since the conclusion of the Sanitary and Epidemiological Service contained the specialties of junior specialists with medical education, we also indicated the data on the personnel hired by the individual entrepreneur in the statements on availability of personnel. Since the validity of the certificate of advanced training of one of the employees, namely the nurse, was about to expire, our lawyers drew the Client’s attention to this problem and explained that at the time of the documents submission to the licensing authority, the document would be invalid, and it could serve as a real ground for the Ministry of Health to refuse the license. Therefore, the submission of documents was postponed until the receipt of a new certificate.
The Client personally submitted the documents to the licensing authority, but at the final stage he entrusted the submission of payment documents to our employees.
After all the aspects of the future dental office’s activity were brought in compliance with the law of Ukraine, the documents were submitted to the Ministry of Health. We obtained a positive decision on the issuance of the Medical License in the shortest possible time.
