Who’s the Client?

In January 2019, our law firm was contacted by two individual entrepreneurs - one from the city of Kharkiv and the other from Volyn region - with the request to obtain a License for the international transportation of goods by trucks.

How did the Client define the task? What solution did we suggest and why?

The Clients wanted to obtain the license in the shortest possible time.

The Client from the city of Kharkiv has already signed a template Motor Carrier Transportation Agreement. However, having analyzed this Agreement, our lawyers found out that the list of freight transport services to be provided to the Client by the motor carrier was much wider than stipulated by the license requirements (pre-trip and after-trip medical examination of drivers). Having thoroughly analyzed the license requirements, our company’s lawyers concluded that this Agreement does not violate the license requirements. So it was decided to submit a package of documents together with this Motor Carrier Transportation Agreement.

What were the challenges in implementing the solution?

When submitting documents to the licensing authority, the employees of the authority, as it was expected, had questions about the types of services listed in the Motor Carrier Transportation Agreement.

Our lawyers explained that since the Client planned to expand its activities in the transportation market, namely to perform internal transportation of dangerous goods and hazardous waste by trucks, the list of services specified in the Motor Carrier Transportation Agreement would be relevant in the near future.

Lawyer’s train of ideas and approach to implementing the solution

Based on the terms and conditions of the Agreement concluded by and between the Client from the city of Kharkiv and the motor carrier, our company’s lawyers found appropriate arguments to explain that although the Agreement provided for the wider range of services, it did not contradict with the license requirements and, accordingly, the licensing authority had no grounds to refuse the license.

Thus, the Client from Volyn region and the Client from the city of Kharkiv obtained a License for the international transportation of goods by trucks (except for transportation of dangerous goods and hazardous waste) on the first try.

The Client from the city of Kharkiv didn’t have to search for another motor carrier and conclude a new agreement that saved him time and money.
