  • According to the License Provisions, to get that license, a licensee among other should submit a document that confirms professional aptitude of the head of the legal entity or his corresponding department for taking position connected with precursor handling.
  • The law does not set out clearly what document is that. However, the licensing authority’s practice has been set up so that this document should be a diploma of higher education with Chemistry-based specialties.

The head of the enterprise himself or the head of department of that enterprise connected with precursor turnover is not obliged to have it. It is enough to have at least one chemist in the staff.

In his staff, this Client had an employee with education in chemical specialty. He had a diploma of graduation of secondary technical school. In spite of the fact that that a secondary technical school is considered as higher education institution of accreditation level one, the client had doubted whether that diploma was suitable for the purposes of getting a license.

Implementations of solution

  • Having regard to the fact that there is no clear requirement set out by the law about confirmation of the above-mentioned qualification and that it was nowhere specified that it should be namely a diploma of higher education issued by education institutions of accreditation levels 3-4, our lawyers submitted the copy of the above-mentioned diploma, for they had had consultations at the State Medicine Service before concerning this matter and were aware what namely the licensing authority wanted to see. 
  • The client could get the required permitting document within the specified deadline.

  • When analyzing independently the licensing conditions, there often arises a number of questions concerning this or that formulation, which in turn has a significant meaning at getting the necessary documents. 

In particular, in the licensing provisions for turnover of psychotropic substances and precursors, such a formulation is used as “a certificate, evidence, diploma that confirms the professional aptitude for working with precursors”. As of today, none of the above-mentioned documents is issued by anybody. Many licensees are disoriented by such norms.
