Documents required for adoption of a child by a foreigner
The general list of documents to be provided by the Client for the adoption of the child:
- A copy of the document certifying the identity;
- A Ukrainian residence permit;
- A permission of the competent authority of the applicant’s country of residence (it can be the Service of Children Affairs or the State Migration Service) for the entry and future permanent residence of the adopted child (except for foreigners residing in the territory of the country with which Ukraine has a visa-free regime);
- Written consent of the second spouse for the adoption of the child (in case of adoption of the child by one of the spouses);
- Statements on the size of salary or other income;
- The marriage certificate;
- A document confirming the right of ownership (or use) of the apartment;
- Written consent of a foreigner to receive data about him/her from law enforcement agencies of foreign states and Interpol.

A person wishing to adopt a child must not be registered or treated in a psychoneurological or drug dispensary, as well as be convicted of crimes against life and health or under other articles of the Criminal Code of Ukraine.
The list of individuals who are not allowed to adopt a child in Ukraine include:
- Same-sex couples;
- Persons recognized as limited in capacity and incapable;
- Individuals that do not have permanent residence or permanent income;
- Stateless persons or unmarried foreign citizens (except for the relatives of the child);
- Individuals suffering from illnesses listed by the Ministry of Health or those who are in need for constant third-party care;
- Individuals who abuse alcoholic beverages or narcotic drugs;
- Persons deprived of parental rights in relation to another child, or who were adoptive parents, but the adoption was canceled or invalidated from their fault.
Answers to frequently asked questions
The Family Code of Ukraine sets forth a number of criteria, norms and requirements for candidates for adoption. In particular, it states that the minimum age of an adopter must be 21 years (only if you are not a relative of the child). There is one more requirement to the age of the adopter: the child must be at least 15 years younger than the adopter.
Persons who are not married to each other cannot adopt the same child. If such persons live as a family - in common-law marriage, the court may approve the adoption of a child by them. If a child has only a mother, he/she csnnot be adopted by a man with whom his mother is not married. If the child has only a father, he/she cannot be adopted by a woman with whom he is not married. But if such persons live as a family, the court may approve the adoption of a child by them. If the child has only a mother or only a father, who in connection with the adoption loses legal ties with him, the adopter of the child may be a single man or a single woman.
Yes, you can. In case of adoption of an adult, the age difference between an adoptive parent and an adoptee shall be no less than eighteen years.

What factors does the court take into account when deciding on the adoption of a child by a foreigner?
When considering cases related to adoption of children in Ukraine, the court must first and foremosе be guided by the interests of the child.
Therefore, the court studies all the circumstances of significant importance, in particular:
- The health condition and financial situation of the adopter;
- The adopter’s marital status and living conditions;
- The adopter’s stance towards the child’s upbringing;
- The motives for the adoption.
In addition, the child’s personality and health condition, as well as his/her relations with the potential adopter are taken into account.
How to adopt a spouse’s child ?
First of all, if a legal spouse wants to adopt a child (children) of the wife or husband from the first marriage, it is necessary to contact the Service of Children Affairs and get a conclusion on expediency of adoption.
The list of documents that are required to obtain the adoption decision include:
- The candidate’s application + copy of the passport;
- A certificate from the placement of work on the salary or the declaration of income;
- An application of the second spouse and the consent of the children;
- A certificate from the polyclinic about the state of health of the child;
- A document confirming the right of ownership of the apartment;
- A conclusion on the health condition of the applicant;
- A document confirming that the adopter is not deprived of parental rights;
- A copy of the birth certificate of the children;
- A family composition certificate;
- A certificate of no criminal conviction for the adopter;
- A copy of the marriage certificate.
