Obtaining a Certificate on Sanitary and Epidemiological Inspection (hereinafter, the SES CErtificate) for the premises where you plan to carry out activities involving medical practice is one of the first steps that must be taken, prior to obtaining a medical practice license. Such premises must be in your ownership or use.

However, what to do if it turns out that your premises are smaller than it is allowed? Where to find answers to all the questions pertaining to the SES Certificate?

Obligation to obtain a SES Act

Without a SES certificate, you simply cannot get a license, since licensing requirements clearly indicate the obligation of the license applicant to ensure that the premises comply with the sanitary standards. And such compliance is confirmed by this very Certificate.

The only exceptions are those entrepreneurs who plan to obtain a license exclusively for the provision of primary health care. It is not necessary for them to have a SES Certificate. At the same time, this does not exempt them from compliance with the norms for the square area of the рremises.

The SES act is issued by the territorial administrations of the State Service Of Ukraine on Food Safety and Consumer Protection

Answering this question, it should be noted that there is currently no unified normative legal act that would regulate the inspection procedure and the requirements necessary for obtaining the Sanitary and Epidemiological Inspection Certificate for a facility.

Now there is only a law and a certain number of orders of the Ministry of Health, which contain provisions partially related to this issue. However, the regulatory legal act that regulates precisely the procedure for issuing the SES Certificate is currently unavailable.

Such inconsistency of legal acts raises a number of issues and unresolved situations, which in practice creates difficulties not only for the State Service Of Ukraine on Food Safety and Consumer Protection but also for the person who must receive the relevant SES Certificate.

Prior to the arrival of the State Service Of Ukraine on Food Safety and Consumer Protection, it is almost impossible to be 100% sure that absolutely all sanitary standards are met.

In addition to sanitary norms, compliance with SNiP norms, which determine the structure and minimum requirements for the square area of ??an office where medical practice will be conducted, is also mandatory. Norms of SNiP can be found for certain categories of medical offices.
