For an energy company, mobilization risk is more than a staffing issue. Losing key employees can mean shutting down a facility where people cannot simply be replaced quickly or new staff trained during a crisis.
The solution may seem obvious: critically important enterprise status allows the company to secure mobilization deferments for such employees. But this is where the first practical difficulty arises: simply belonging to the energy sector guarantees nothing. The company must prove that it meets the established criteria, correctly identify the authority to apply to, and prepare documents demonstrating its actual operations.
The Ministry of Energy requires proof not of a formal “connection to the sector,” but of actual, documented operations: the right to generate electricity, actual generation, sales of the electricity generated, and specific volumes.
In practice, documents showing the full picture of the company’s operations may be used for this purpose: an electricity generation license, contracts for the sale of electricity, information on generation and sales volumes, and documents confirming compliance with the other established requirements.
Putting this evidence together on your own is not as easy as it may seem: a license alone proves very little because it confirms the right to conduct the activity, not that the activity is actually being carried out. Any unnecessary or contradictory document in the package may lead to a refusal or delay in review.

Can an Electricity Producer Obtain Critically Important Enterprise Status?
Yes. An electricity producer can obtain critically important enterprise status. To do so, it must demonstrate compliance with the criteria established for the relevant sector and meet the general requirements prescribed by law.
The general procedure for designating critically important enterprises is established by Resolution No. 76 of the Cabinet of Ministers of Ukraine. At the same time, energy companies are subject to criteria set by the Ministry of Energy of Ukraine as the competent sectoral authority.
For an electricity producer, this means that it must demonstrate not merely that it belongs to the energy sector, but that it actually carries out the relevant activity.
This is why, when preparing the documents, it is important to demonstrate several elements at the same time:
- the company has the right to generate electricity;
- the company actually carries out electricity generation;
- the company sells the electricity it generates;
- the company has documented volumes of this activity.
The company must also meet other requirements considered when determining whether it qualifies as critically important. In particular, the authorities check for the absence of outstanding obligations to the budget, as well as payroll indicators.
Accordingly, documents relating only to electricity generation are not enough in this situation. A complete package must be prepared that demonstrates both the company’s importance to the sector and its compliance with the general requirements.

Client Situation: A Green Energy Producer Needed Mobilization Deferments for Its Team
A client approached us with precisely this request—an enterprise that generates electricity from renewable sources and sells it to the State Enterprise “Guaranteed Buyer.”
Our first task was to determine which criterion applied and which authority the client should use for the procedure. Given the nature of the company’s operations, we determined that the application should be submitted to the Ministry of Energy of Ukraine as the competent sectoral authority.
Next, we analyzed which documents could most convincingly demonstrate that the client met the criteria. One of the key documents was the license issued by NEURC for electricity generation. It confirmed that the company had the legal right to carry out the relevant activity.
However, the license alone was not sufficient. It confirms the right to conduct the activity, but does not show that the company actually generates electricity or the volumes it generates.
We therefore also used the contracts with the State Enterprise “Guaranteed Buyer” under which the client sold the electricity it generated.
These documents confirmed not only the fact of electricity sales, but also the actual volumes of generation and sales. This allowed us to demonstrate the company’s real operations rather than merely its formal connection to the energy sector.
At the same time, we checked compliance with the other requirements that must be considered when obtaining critically important enterprise status.
In particular, we checked that there were no outstanding debts, and reviewed the salary level—approximately UAH 26,000—to identify in advance whether this indicator could raise any issues.
Thus, even before submitting the documents, we carried out a comprehensive review of the company: from its core operations and license to electricity sale contracts, generation volumes, outstanding debts, and payroll indicators.

How We Compiled Evidence of Actual Operations for the Ministry of Energy
After analyzing the situation, we developed a strategy for the client to complete the procedure through the Ministry of Energy of Ukraine.
Our main task was not simply to collect documents, but to organize them into clear evidence of the company’s operations and present all of this in a cover letter.
First, we reviewed the contracts with the State Enterprise “Guaranteed Buyer” and the related acceptance certificates. We also checked the generating capacities listed in the NEURC license.
These documents therefore allowed us to demonstrate, step by step:
- the company’s right to generate electricity;
- the actual generation of electricity;
- the sale of the electricity generated;
- the volumes of generation and sales.
We paid particular attention to the document package itself. We checked that the company information was consistent across all documents and that each document had practical value in supporting the stated basis, because unnecessary documents can significantly slow the review process and may even lead to a refusal.
After completing the review, we prepared the document package and submitted it to the Ministry of Energy.
As a result, our client obtained critically important enterprise status in just two weeks.
