For a foreigner coming to Ukraine as a volunteer, lawful stay is just as important as the opportunity to participate in volunteer activities. This is especially relevant when the person plans to remain in Ukraine for several months and needs to obtain a temporary residence permit.

Previously, foreigners entering Ukraine specifically for volunteer activities had to obtain a long-stay type D visa. However, the rules changed in July 2026: the law introduced new categories of persons who may obtain a residence permit without first obtaining such a visa.

The changes directly affect certain foreigners who come to Ukraine for volunteer activities. But not all of them. Not every volunteer can use the new procedure: the person must meet the conditions established by law and have documents confirming the relevant basis for stay.

What Changed: New D Visa Exemptions for Foreign Volunteers

The rules governing the stay of foreigners in Ukraine were supplemented with a new exemption effective July 1, 2026 for categories of persons defined by law. This became possible after the entry into force of Law of Ukraine No. 4816-IX dated March 12, 2026, which amended the Law of Ukraine “On the Legal Status of Foreigners and Stateless Persons.”

For a specific category of volunteers, obtaining a D visa before applying for a residence permit is no longer mandatory. This allows them to proceed directly to preparing documents that confirm the basis for temporary residence.

The key point is that the exemption applies only to a specific category, not to all volunteers. There is also a citizenship restriction: citizens of the Russian Federation cannot use this exemption.

The new procedure is temporary: it applies during martial law and for one year after martial law is terminated or canceled. Therefore, before starting the application process, it is important to verify whether the particular situation falls within the exemption provided by law.

Who Can Use the New Rules and How to Obtain a Temporary Residence Permit

The new rules are available to foreigners and stateless persons who come to Ukraine:

  • to participate in international or regional volunteer programs;
  • to participate in the activities of organizations and institutions that engage volunteers in accordance with volunteer activity legislation.

The decisive factor is not simply the label “volunteer,” but the existence of a legally recognized basis for the activity and the ability to document it. In other words, the person must enter the country at the invitation of a specific volunteer organization.

In practice, this shortens the process for the volunteer: instead of first obtaining a long-stay visa and then applying for a residence permit, the person can focus immediately on confirming the volunteer activity and preparing the documents required for the permit.

Particular attention should be paid to documents issued by the organization engaging the foreigner in volunteer activities. For example, this may be an Invitation containing the volunteer’s details and a brief description of the mission. The document must confirm the actual basis for the stay and be consistent with the information in the foreigner’s other documents.

For each volunteer, the date of entry into Ukraine, citizenship, purpose of stay, the organization whose activities the person participates in, and the documents confirming these circumstances should be checked separately.

Benefits of the New Rules and Who Is Not Covered by the Exemption

The most obvious benefit of the new rules is that foreign volunteers have fewer preliminary procedures to complete. Previously, for the relevant category of persons, obtaining a D visa was part of the process of obtaining a residence permit. Now, if the statutory conditions are met, this step can be skipped.

For volunteer organizations, this also means being able to engage foreign specialists and volunteers more quickly in work in Ukraine.

However, simplifying the procedure does not mean that a residence permit is issued automatically. Proper confirmation of the basis for stay remains the most important requirement.

If a foreigner is actually engaged in volunteer activities in Ukraine, those activities must be properly documented. The fact that a person volunteers is not always sufficient by itself to obtain a residence permit—the documents must clearly confirm the foreigner’s participation in the relevant volunteer program or the activities of the organization.

The documents should first be prepared and completed correctly, including the Submission in accordance with statutory requirements. This will confirm the volunteer’s status and help avoid a situation in which the person is genuinely engaged in volunteer activities but lacks sufficient documentation to obtain a residence permit.

If, in a particular situation, the volunteer activity cannot be confirmed with the required documents, other lawful grounds for residence in Ukraine may be considered—for example, employment, study, or family reunification. In other words, even in such a situation, another lawful route to a residence permit may be available depending on the circumstances.

Important! The new rules apply only during martial law and for one year after its termination or cancellation. Therefore, when planning a foreigner’s long-term stay, it is important to consider not only the current rules but also possible changes to the person’s status after this period ends.

The right not to obtain a D visa should also not be confused with the right to stay in Ukraine without restrictions. A visa and a temporary residence permit serve different purposes: the new law removes the visa requirement for specified categories, but the lawfulness of the person’s continued stay is determined under the migration rules and the status obtained.

For organizations that regularly engage foreign volunteers, it is especially important to review the documents before the foreigner arrives in Ukraine. This makes it possible to determine in advance whether the new exemption applies, which documents need to be prepared, and whether a residence permit is required.
