Inheritance registration in Ukraine often does not end with obtaining a certificate of inheritance. If you live abroad, you may need a clear set of documents confirming your ownership rights for your personal records, a future sale, a bank, or a tax advisor in your country of residence.

First Stage: Accepting the Inheritance

Accepting an inheritance and preparing documents for use abroad are two different stages. Your first task is to accept the inheritance and formalize your ownership rights in Ukraine. The second is to prepare documents that can be used outside Ukraine.

These stages are connected, but they are not the same. An apostille or translation does not replace acceptance of the inheritance, and a certificate of inheritance by itself does not guarantee that a foreign bank or tax authority will accept it without additional documents.

What the Heir Must Do Personally at the First Stage

If the heir was not permanently residing with the deceased when the inheritance was opened, the heir must submit an application to accept the inheritance. Under Ukrainian law, this application must be submitted personally by the heir, and the general deadline for accepting an inheritance is six months. A power of attorney therefore cannot be used as a substitute for the heir’s personal application. If the heir is applying from abroad, the procedure for submitting the application and certifying the heir’s signature should be agreed in advance with the notary handling the inheritance matter.

1. The document confirming the death of the deceased, as well as documents proving the family relationship or the will.
2. Available title documents for the apartment, house, or land plot.
3. The heir’s passport details, RNOKPP, if available, and the correct spelling of the name in foreign documents.
4. Whether an inheritance case has already been opened, whether there are other heirs or a will, and whether there are any arrests, debts, or discrepancies in the documents.
5. The intended use of the Ukrainian documents abroad and the requirements of the specific recipient.

Second Stage: Apostille, Notarized Translation, and Delivery of Inheritance Documents

After obtaining a certificate of inheritance for a land plot or apartment, you need to prepare it for use abroad. First, we determine exactly what actions and situations abroad may require the certificate of inheritance and what you intend to use it for. This determines how the document should be prepared for use abroad.

For countries that are parties to the 1961 Hague Convention, a Ukrainian official document will generally require an apostille issued by the competent authority of the state in which the document was issued. However, before requesting an apostille, three things should be checked:

• whether the destination country is a party to the Convention;
• which specific document the foreign institution requires;
• whether it has any additional requirements regarding translation, notarization, or the date on which the document was issued.

An apostille confirms the formal authenticity of the signature and the authority of the official who signed the document, but it does not replace the foreign recipient’s review of the document’s contents.
