The transportation of precursors is an economic activity subject to enhanced government control. Ukrainian legislation establishes specific requirements not only for business entities involved in the handling of precursors but also for vehicles, personnel, documentation procedures, and the conditions for storing controlled substances during transportation.

Inspection practices involving the State Service of Ukraine on Medicines and Drugs Control, the National Police, and other regulatory authorities show that violations most often occur during logistics operations. Common issues include transporting precursors without the required license, errors and inaccuracies in consignment notes and other transport documents, inadequate vehicle equipment, failure by the designated responsible person to perform their duties, or even the absence of such a person altogether.

New Rules for the Transportation of Precursors and Medical Cannabis in Ukraine

Following the adoption of Cabinet of Ministers of Ukraine Resolution No. 1005 dated September 3, 2024, the regulatory framework governing the transportation of narcotic drugs, psychotropic substances, and precursors in Ukraine was significantly updated. Under this resolution, the procedure for transporting these substances and the rules for preparing accompanying documents were updated. The new provisions provide more detailed requirements for the movement of such goods, including medicines containing narcotic or psychotropic substances, as well as cannabis based products and medicines manufactured using cannabis.

In addition, amendments to Article 26 of the Law of Ukraine “On Narcotic Drugs, Psychotropic Substances and Precursors” introduced a mandatory requirement to involve state-owned security entities when transporting controlled substances within Ukraine.

At the same time, Cabinet of Ministers of Ukraine Resolution No. 1316 dated November 15, 2024, amended the rules for transporting medicines. In particular, when transporting narcotic drugs and/or psychotropic substances in the form of medicines in quantities not exceeding 200 kg, security provided by a state-owned security entity is not mandatory. However, if necessary, the head of the business entity may arrange such security.

Please note! This exception applies exclusively to medicines. If you are transporting raw materials, cannabis plant material intended for production, or concentrated chemical precursors, the requirement to involve state-owned security, such as the Police Security Service, remains applicable regardless of the shipment volume, unless the licensing conditions for a specific substance list expressly provide otherwise.

Is a License Required to Transport Precursors?

The transportation of precursors, as well as narcotic drugs, psychotropic substances, cannabis plant material, and medicines containing these substances within Ukraine, is permitted only for business entities holding a valid license authorizing the transportation of such substances.

Without the appropriate license, such transportation is prohibited. An exception applies when transportation is carried out by authorized government authorities, including the police, the Security Service of Ukraine, customs authorities, and other authorized bodies acting within their legal powers, particularly in relation to seized substances.

Vehicle Requirements for Transporting Precursors

Controlled substances may only be transported in vehicles that comply with the applicable technical safety requirements and traffic regulations. The main vehicle requirements include:

Permitted modes of transport

Transportation by road or, in certain cases, by air is permitted. Railway transportation, except for the transportation of precursors included in List No. 2 of Table IV of the List, and postal shipments are prohibited.

Technical condition

The vehicle must be in proper technical condition, confirmed by the relevant documentation.

Mandatory emergency equipment

The vehicle must be equipped with emergency equipment, including a powder or carbon dioxide fire extinguisher with a capacity of at least 5 liters, wheel chocks, and tools for minor repairs.

Cargo protection

Appropriate conditions must be provided to ensure the safety and security of the cargo throughout transportation.

Security and monitoring system

For significant quantities, including more than 10 kg or liters of cannabis and cannabis based products, the vehicle must be equipped with GPS or satellite route monitoring.

 

Transportation must also comply with safety requirements and prevent unauthorized persons from accessing the cargo.

Personnel Requirements for Transporting Controlled Substances

Only authorized employees of the license holder who have been formally appointed by the company's management may be involved in the transportation. The main requirements include:

  • the appointment of an authorized person to accompany the shipment during transportation;
  • the authorized person's responsibility for controlling, accounting for, and transferring the cargo;
  • providing the driver with instructions before the trip regarding the specific transportation requirements;
  • mandatory verification of package integrity and confirmation that the quantity of the cargo corresponds to the accompanying documents;
  • maintaining records of the movement of the substances in paper or electronic form, including information on the total weight of the cargo, the number of packages, the final delivery destination, the details of the consignment note (its number and date), as well as the Unified State Register of Enterprises and Organizations of Ukraine code and the name of the consignee.

Please note! The head of the company is personally responsible for the safety and security of the cargo and for maintaining the confidentiality of transportation information.

Regarding the duties of the authorized person, the Procedure establishes the following responsibilities:

  • accompanying narcotic drugs, psychotropic substances, and precursors, as well as cannabis intended for medical purposes, cannabis plant material, and medicines manufactured on its basis, during transportation to their destination;
  • instructing the driver responsible for transporting narcotic drugs, psychotropic substances, precursors, cannabis intended for medical purposes, cannabis plant material, and medicines manufactured from these substances;
  • checking the integrity of containers and packaging, verifying the number of packages, and accepting narcotic drugs, psychotropic substances, precursors, cannabis intended for medical purposes, cannabis plant material, and medicines manufactured on their basis;
  • transferring narcotic drugs, psychotropic substances, precursors, cannabis intended for medical purposes, cannabis plant material, and medicines manufactured from these substances to the consignee.

Documentation Required for the Transportation of Precursors

The transportation of precursors may only be carried out on the basis of properly prepared accompanying documents. The primary document is the consignment note, which:

  • confirms the transfer of the cargo;
  • is signed by the authorized person;
  • contains information about the vehicle registration number, the transportation route, and the consignee.

Individuals may transport such medicines only for their own medical treatment, provided that the medicines were obtained under an electronic prescription.
